    1. Introduction

    Welcome to Veritas Savings and Credit Cooperative Society Limited ("Veritas Sacco"). These Terms of Service ("Terms") govern your relationship with Veritas Sacco and your use of our services, accounts, website, and mobile applications. By becoming a member, opening an account, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

    Please read these Terms carefully before engaging with our services. If you do not agree to these Terms, you should not use our services or become a member of Veritas Sacco.

    2. Definitions

    Throughout these Terms, the following definitions apply:

    • "Sacco", "we", "us", or "our" refers to Veritas Savings and Credit Cooperative Society Limited.
    • "Member", "you", or "your" refers to any individual or entity that has joined Veritas Sacco according to our membership requirements.
    • "Services" refers to all financial and non-financial services offered by Veritas Sacco.
    • "Shares" refers to the ownership interest in Veritas Sacco purchased by members.
    • "Deposits" refers to funds placed by members into their deposit accounts.
    • "Board" refers to the Board of Directors of Veritas Sacco.
    • "Membership Number" refers to the unique identifier assigned to each member upon registration.

    3. Membership

    3.1 Eligibility

    Membership in Veritas Sacco is open to individuals who meet the following criteria:

    • Are at least 18 years of age or legally emancipated minors
    • Have a valid national identification card or passport
    • Complete the membership application process
    • Purchase the minimum required shares
    • Pay the membership fee
    • Agree to comply with these Terms and the Sacco's by-laws

    3.2 Application Process

    To become a member, you must:

    1. Complete and submit the membership application form
    2. Provide all required identification documents
    3. Pay the non-refundable membership fee
    4. Purchase the minimum required shares

    The Board reserves the right to approve or reject any membership application at its discretion.

    3.3 Membership Number

    Upon successful registration, you will be assigned a unique membership number. This number:

    • Is automatically generated based on your full name, user ID, and year of joining
    • Follows the format: [First name initial][Last name initial][User ID padded with zeros]/[Last two digits of joining year]
    • For example, a user with full name "Adam Brown" and ID 1 who joined in 2025 would have membership number: AB001/25
    • Is required for all transactions and communications with the Sacco
    • Is unique and cannot be changed

    3.4 Rights and Responsibilities

    As a member, you have the right to:

    • Participate in general meetings and vote on Sacco matters
    • Elect and be elected to leadership positions within the Sacco
    • Access loans and other financial services offered by the Sacco
    • Receive dividends on shares as declared by the Board

    As a member, you have the responsibility to:

    • Comply with these Terms and the Sacco's by-laws
    • Maintain the minimum required shares
    • Repay loans and other obligations promptly
    • Update your personal information when changes occur
    • Protect your account information and credentials

    4. Accounts

    4.1 Types of Accounts

    Veritas Sacco currently offers two main types of accounts:

    • Shares Account: Represents your ownership stake in the Sacco
    • Deposits Account: For your savings and fund management

    4.2 Account Opening

    To open an account, you must:

    • Be a registered member of Veritas Sacco
    • Complete the account opening form
    • Provide any additional required documentation
    • Make the minimum initial deposit as specified for each account type

    4.3 Account Numbers

    Each member is assigned unique account numbers for different account types:

    • Shares Account: The account number format is 1028670# followed by your membership number
    • Deposits Account: The account number format is 1028555# followed by your membership number
    • These personal account numbers must be used when making payments or transactions
    • The account numbers mentioned in other sections of this document (0110180280001 for deposits and 0110180280002 for shares) are the group account numbers and should not be used for individual transactions

    4.4 Account Management

    You are responsible for:

    • Keeping your account information confidential
    • Notifying us immediately of any unauthorized transactions
    • Ensuring that your account has sufficient funds for any transactions
    • Regularly reviewing your account statements for accuracy

    4.5 Account Closure

    You may close your account at any time by submitting a written request. Account closure is subject to:

    • Settlement of all outstanding obligations
    • Processing time of up to 30 days
    • Applicable fees as per our fee schedule

    The Sacco reserves the right to close an account for violations of these Terms or for other legitimate reasons.

    5. Deposits

    5.1 Deposit Account

    The Deposits Account allows you to save money with Veritas Sacco. Key features include:

    • Competitive interest rates as determined by the Board
    • Flexible deposit options
    • The basis for loan qualification
    • Access to funds when needed, subject to withdrawal terms

    5.2 Making Deposits

    You can make deposits to your account through:

    • Mobile money transfer using Paybill Number: 400222 and your personal Deposits Account Number (1028555# followed by your membership number)
    • Direct bank transfers
    • Cash deposits at designated Sacco branches
    • Check deposits (subject to clearance)

    Important: When making deposits, always use your personal account number (1028555# followed by your membership number) as the account number. Do not use the group account number (0110180280001).

    5.3 Interest on Deposits

    Interest on deposits is:

    • Calculated based on the daily balance method
    • Credited to your account monthly
    • Subject to change as determined by the Board
    • Subject to applicable taxes as required by law

    5.4 Withdrawals

    Withdrawals from your Deposits Account:

    • Require proper identification
    • May be subject to processing timeframes
    • May be subject to withdrawal fees
    • May have daily and monthly limits

    6. Shares

    6.1 Shares Account

    The Shares Account represents your ownership stake in Veritas Sacco. Key features include:

    • Earn dividends based on the Sacco's annual performance
    • Increase your borrowing capacity
    • Provide voting rights in Sacco governance
    • Help build the foundation for the Sacco's growth

    6.2 Purchasing Shares

    You can purchase shares through:

    • Mobile money transfer using Paybill Number: 400222 and your personal Shares Account Number (1028670# followed by your membership number)
    • Direct bank transfers
    • Cash payments at designated Sacco branches

    Important: When purchasing shares, always use your personal account number (1028670# followed by your membership number) as the account number. Do not use the group account number (0110180280002).

    6.3 Dividends

    Dividends on shares:

    • Are declared annually based on the Sacco's performance
    • Are approved by members at the Annual General Meeting
    • Are distributed as determined by the Board
    • Are subject to applicable taxes as required by law

    6.4 Transfer and Withdrawal of Shares

    Transfer and withdrawal of shares:

    • Require written application
    • Are subject to Board approval
    • May be subject to a retention period
    • May be subject to fees and charges

    Important: Members must maintain the minimum required shares to maintain active membership and access to Sacco services.

    7. Loans and Credit Facilities

    7.1 Loan Eligibility

    To be eligible for loans, you must:

    • Be a member in good standing for the minimum required period
    • Have the minimum required shares and deposits
    • Have a good repayment history (if applicable)
    • Meet any other criteria as specified in the loan policy

    7.2 Loan Application

    The loan application process includes:

    • Completing the loan application form
    • Providing required documentation
    • Securing appropriate guarantors as required
    • Paying applicable application fees

    7.3 Loan Approval

    Loan approval is based on:

    • Your creditworthiness
    • Your ability to repay
    • The purpose of the loan
    • Available security or collateral
    • Compliance with the Sacco's loan policies

    7.4 Loan Repayment

    Loan repayment terms include:

    • Adherence to the agreed repayment schedule
    • Interest charges as specified in the loan agreement
    • Penalties for late payments
    • Options for early repayment (which may include fees)

    7.5 Default

    In case of default:

    • Your deposits and shares may be used to offset the loan
    • Guarantors may be called upon to repay the loan
    • Additional penalties and charges may apply
    • Legal action may be taken to recover the debt

    8. Fees and Charges

    Veritas Sacco imposes various fees and charges for its services, including but not limited to:

    • Membership fees
    • Account maintenance fees
    • Transaction fees
    • Loan application fees
    • Loan processing fees
    • Statement fees
    • Withdrawal fees
    • Cheque processing fees

    All fees and charges are available in our Fee Schedule, which may be updated from time to time. The current Fee Schedule is available at our branches and on our website.

    9. Privacy and Data Protection

    9.1 Data Collection

    We collect personal information to:

    • Verify your identity
    • Process your applications
    • Provide services to you
    • Communicate with you
    • Comply with legal and regulatory requirements

    9.2 Data Use and Disclosure

    We may use and disclose your information:

    • To process transactions
    • To provide you with services
    • To communicate with you about your accounts

    10. Communications

    You are responsible for keeping your contact information up to date. Failure to receive a communication due to outdated contact information will not excuse you from any obligations.

    11. Termination of Membership

    11.1 Voluntary Termination

    You may terminate your membership by submitting a written request. Voluntary termination is subject to:

    • Settlement of all outstanding obligations
    • Processing time of up to 90 days
    • Applicable fees as per our fee schedule

    11.2 Involuntary Termination

    The Sacco may terminate your membership for:

    • Violation of these Terms or the Sacco's by-laws
    • Fraud or misrepresentation
    • Failure to maintain the minimum required shares
    • Delinquent loan repayments
    • Any other reason as determined by the Board

    11.3 Effects of Termination

    Upon termination of membership:

    • Your accounts will be closed
    • Outstanding loans must be repaid in full
    • Your shares will be liquidated and proceeds applied to any outstanding obligations
    • Any remaining balance will be paid to you

    12. Amendments to Terms

    Veritas Sacco reserves the right to amend these Terms at any time. Amendments may be made for reasons including but not limited to:

    • Changes in laws and regulations
    • Changes in our services
    • Security enhancements
    • Business needs

    We will notify you of any material changes to these Terms through appropriate channels. Your continued use of our services after the effective date of the changes constitutes your acceptance of the amended Terms.

    13. Governing Law

    These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms or your relationship with Veritas Sacco shall be subject to the exclusive jurisdiction of the courts in Kenya.
